  1. I am writing to express my concerns regarding my final lifeguard paycheck. The paycheck for the last pay period of the 2013 lifeguarding season, which extended to Labor Day, did not account for the 4.5 hours of overtime worked on Labor Day, September 2, a recognized federal holiday. As per the earning statement issued September 19, 2013, I was paid for 24.21 hours at $8.5000/hour, and not credited for any hours at the standard $12.7500/hour rate. Additionally, the paycheck was not delivered to me until October 4, 2013, 32 days after my final day of work. After numerous phone calls, emails, and office visits to Spencer Henderson, Aquatics Director, and Ruby Torres, Human Resources, on the dates of 9/10/13, 9/14/21, 9/23/13, 9/24/14, and 10/4/13 regarding the whereabouts of the paycheck it was not until over a month later I received my check. As per the California Labor Code section 202 and 203, I am requesting compensation of the unpaid overtime and the wait time penalty amounting to 30 days’ worth of my average daily pay. I am expecting to hear back from the company within a week. If I have not heard back further action will be taken.
