  1. You may already know about the BBS 'sting' six months ago in Munroe
  2. Falls, OH for "disseminating matter harmful to juveniles." Those
  3. charges were dropped for lack of evidence. Now a trial date of
  4. 1/4/93 has been set after new felony charges were filed, although
  5. the pretrial hearing revealed no proof that *any* illegal content
  6. ever went out over the BBS, nor was *any* found on it.
  7. For those unfamiliar with the case, here's a brief summary to date.
  8. In May 1992 someone told Munroe Falls police they *thought* minors
  9. could have been getting access to adult materials over the AKRON
  10. ANOMALY BBS. Police began a 2-month investigation. They found a
  11. small number of adult files in the non-adult area.
  12. The sysop says he made a clerical error, causing those files to be
  13. overlooked. Normally adult files were moved to a limited-access
  14. area with proof of age required (i.e. photostat of a drivers
  15. license).
  16. Police had no proof that any minor had actually accessed those
  17. files so police logged onto the BBS using a fictitious account,
  18. started a download, and borrowed a 15-year old boy just long enough
  19. to press the return key. The boy had no knowledge of what was going
  20. on.
  21. Police then obtained a search warrant and seized Lehrer's BBS
  22. system. Eleven days later police arrested and charged sysop Mark
  23. Lehrer with "disseminating matter harmful to juveniles," a
  24. misdemeanor usually used on bookstore owners who sell the wrong
  25. book to a minor. However, since the case involved a computer,
  26. police added a *felony* charge of "possession of criminal tools"
  27. (i.e. "one computer system").
