  14. There would be a disclaimer below the email form saying "By clicking submit, you will be opted into XYZ LLCs and Marketing Service XYZs email list".
  15. The lists would be on two separate ESPs and be sending from two different companies.
  16. Unsubscribing from one email list will not effect the subscription status on the other, as these are two separate companies.
  17. The general appeal is that I can have two different email lists, one "dirty" one that sends 1-2 times per day, and another "clean" one that sends much less aggressively and contains less ads.
  18. Is this against any email marketing guidelines? I've been searching and could not find anything, but perhaps I am looking in the wrong place and people have been sued millions for this aha
  19. Don’t believe so. If they agree to sign up to both then you’re in the clear.
  20. As long as you’re not adding them to both against their will/knowledge it’s completely legal. Just remember to include your business address/contact and an unsubscribe option in every e-mail. (Believe those are the rules)

  22. I'm pretty sure if you're clear that is what someone is opting into then you're good.
  23. If you're targeting people based in the EU then your tick box should ideally not be pre-checked as per GDPR.
  24. If your targeted customers are into B2C space, then yes, you'd need to mentioned in double optin email confirmation.
  25. P.S. i'm not legal professional, i'm sharing this information as per my best knowledge.
  26. I have seen sweepstakes websites from my country (Denmark EU) where the terms had listed all the companies you accepted receiving marketing material/calls from
  27. Gotta have 2 checkboxes, one for each ML
  28. One checkbox for both isn't ok far as I know.
  29. What about one opt in button, and then underneath it there is a check box that says "Yes! Also subscribe me to XYZ for daily deals". This checkbox would be prechecked as I am not in the EU
  30. What about one opt in button, and then underneath it there is a check box that says "Yes! Also subscribe me to XYZ for daily deals". This checkbox would be prechecked as I am not in the EU
  31. No you can not have prechecked. Its ok if you're not in EU, but your website could be accessible to EU citizen, within or outside EU.
  32. The traffic will be redirected, this is a marketing campaign to generate leads for US businesses so there is no sense in allowing access outside of the US
  33. There's very high chance that EU citizen will access your website in US.
  34. P.S. You should consult any GDPR legal consultant regarding this matter.
  35. I for one couldn't care less about GDPR and have zero intentions to follow it.
